Data Protection in the Application Process

Which data that you provide do we process, and for what purpose?

The data collected in the application process (personal information, postal and contact addresses and the documentation required for the application, such as the cover letter, resume and references) are recorded by AKQUINET in a database and are stored, processed and used exclusively for application management within the AKQUINET group of companies. No data transmission to third parties takes place. The protection of your personal data is guaranteed at all times.

No legal entitlement arises regarding the use of data by AKQUINET. We also reserve the right to delete the data, in whole or in part, without specifying any reasons, as long as this does not represent an infringement of any legal requirements.

What is the legal basis for processing?

The legal basis for processing your personal data in this application procedure is primarily § 26 of the German Federal Data Protection Act (BDSG) in the version valid as of 25.05.2018. Processing of data is permitted when required in connection with the decision regarding the establishment of an employment relationship.

Should the data be required for legal proceedings after conclusion of the application procedure, for example, data processing can take place based on the prerequisites from article 6 of the GDPR, in particular to safeguard legitimate interests according to article 6 para. 1 lit. f) of the GDPR. Our interest then lies in the legal proceedings.

How long will the data be stored?

For unsuccessful applications, data provided by applicants will be deleted after 6 months. If your application procedure is successful and you receive a firm job offer, the data is transferred to our personnel information system.

Which recipients receive the transmitted data?

Your application data will be viewed by the personnel department after your application is received. Suitable applications are forwarded internally to the persons responsible for the open position(s) in each department. Within the company, only those persons who require the data to allow our application procedure to proceed in an orderly fashion will have access to the data.

Is there any obligation to provide personal data?

No legal or contractual obligation exists for the provision of your application data. Nonetheless, the provision is required for any employment relationship that may occur subsequent to a successful application. It will not be possible to execute an application procedure if no application data is provided.

Does automated decision-making take place?

No automated decision-making takes place.

What are your rights as an affected person in accordance with GDPR?
